MasterBlue Fulfillment Policies

Refund Policy: Refunds are available only under specific conditions related to the non-delivery of contracted services. Refund requests must be submitted within 14 days of the service start date. Approved refunds will be processed within 7 business days.

Delivery Policy: Our digital services are delivered according to timelines outlined in the agreement. Delivery depends on project scope and client responsiveness. For digital products or reports, delivery is instant upon completion and sent via email or through a shared platform.

Return Policy: As our services are digital and customized, we do not offer returns for completed deliverables. If any deliverable does not meet the agreed specifications, revisions may be requested within 14 days of delivery.

Cancellation Policy: Clients may cancel subscription-based services with 30 days’ written notice. For one-time projects, cancellations must be made before work begins for a full refund. Once work has started, refunds will be prorated based on the project stage.

PCI Compliance: MasterBlue Digital is fully PCI compliant, ensuring that all payment transactions meet the highest security standards. Termination

Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and your exclusive remedy shall be limited to the amount actually paid by You through the Service or $100 USD if You have not made any purchases through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including but not limited to damages for loss of profits, loss of data or other information, business interruption, personal injury, loss of privacy) arising out of or in any way related to the use of or inability to use the Service, third-party software, and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms, even if the Company or any supplier has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to You. In such jurisdictions, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” with all faults and defects without warranty of any kind. To the fullest extent permitted under applicable law, the Company expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, the Company does not warrant that the Service will meet your requirements, be error-free, uninterrupted, or that any defects will be corrected.

Governing Law and Jurisdiction

The laws of the State of Wyoming, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and You hereby irrevocably consent to the jurisdiction and venue of such courts.

For EU Users

If You are a consumer in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident.

US Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country and (ii) You are not listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to accomplish its objectives to the greatest extent possible under applicable law and the remaining provisions will remain in full force.

Waiver: Failure to enforce any right or provision shall not be deemed a waiver of those rights.

Translation

These Terms may have been translated if We have made them available to You in another language. You agree that the original English version will prevail in case of conflict. In the event of any discrepancy between a translated version and the English version of these Terms, the English version shall prevail.

Changes

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice. By continuing to access or use the Service after revisions become effective, You agree to be bound by the updated Terms.
